WorldBy.Com S.p.A. (from now ahead, “WBC”) applies a data privacy policy which complies with the laws in force on the rights of individual to personal privacy, operates and processes personal data in full transparency and make use of appropriate and updated data safety devices.
Management of personal data is carried out in compliance with EU provisions (Directive 95/46/CE and following amendments), and, more specifically, with the provisions of Italian law implementing said EU provisions (“Italian Privacy Code” - Legislative Decree no. 196 of 30 June 2003).
In consideration of the above and pursuant to Section 13 of Italian Privacy Code we are to provide you the following information on personal data management by WBC. For any further information on the matter, please write to the following address: bookings@worldby.com
RECORDED PERSONAL DATA
When a user visits WBC and WBC affiliates web-sites, the system automatically identifies IP address, host name, type of operating system, day and time of visit and web pages visited.
Out of the above listed data, the system then erases IP address and hostname, thus converting the remaining data (number of visits, date and time of the visits, nationality of the user, type of operating system, the pages visited) in anonymous information. Said data are processed for statistic purposes only.
If the user wishes to make bookings or reservations for tourist accommodation providers or other similar items, the data inserted by the visitor when booking, as well as any following communication concerning the same data through WBC will be processed.
In addition to this, in such cases all the data concerning IP address, host name, date and time of the booking, are automatically processed, for the purpose of verification and checking the booking afterwards.
INFORMATION ON PERSONAL DATA SAFETY
All the processed data, are recorded and stored in compliance with the Italian Law in force. Personal data concerning credit card are stored coded.
Purposes and modalities of the processing
The processing of data is carried out with the main purpose of allowing the supply of the services required by the supplier (for instance: controlling the availability of hotel establishments and booking). The personal data, once recorded, may be used, in anonymous format, for statistic purposes on WBC activities.
WBC is an intermediary between the user and the Accommodation providers. By virtue of this agreement, the communications between user and Accommodation providers are to be send only through WBC, who will record said communications as commercial correspondence and will be allowed to utilize them for purposes concerning the execution of the agreement and the protection of its own position of agent. By way of example, WBC will be allowed to control the communications between user and Accommodation providers, in case there are, in said correspondence, elements which are unequivocally finalized to create a direct contact between user and Accommodation providers.
WBC acts only as agent, assumes no liability for accommodation arrangements and cannot be held responsible for actions or omissions of the accommodation providers.
WBC will send to the user who utilizes the services offered by the Accommodation providers, and book trough WBC, via e- mail, a questionnaire for a customer satisfaction review, in order to monitor the level of services offered by WBC affiliated Accommodation providers and keep them up to the highest standards. Also, WBC could send monthly newsletters to travellers who have used its services. The travellers will still preserve the right to unsubscribe in any moment from the mailing list.
The data will be processed mainly with the help of electronic/automated means. They will be recorded and stored on both digital and paper supports, as well as on any other kind of support which may be technically suitable, in compliance with the provisions of Italian Law.
VOLUNTARY NATURE OF PROVIDING THE REQUESTED DATA
In the forms for the collection of data all the fields marked with an asterisk(*) must be filled compulsorily. Should they not be filled, the request sent by the user can not be forwarded and accepted.
ENTITIES TO WHOM OR WHICH THE DATA MAY BE COMMUNICATED
The data will be processed by persons entrusted by WBC pursuant to the instructions collected on data privacy compliance given by WBC.
The data will be communicated to the Accommodation provider selected by the user for the purpose of performing the obligations deriving from the agreement between the user and the Accommodation provider or for the supply of the services required (collection of information, booking).
During high season or upon demand by the user, WBC will extend the search also to further Accommodation provider, similar to the one which has been selected by the user.
The personal data may be communicated to WBC consultants for legal and tax matters.
RIGHTS OF THE DATA SUBJECT
With reference to the data processing involved, Section 7 of Italian Law Decree 196/203 will apply:
1. A data subject shall have the right to obtain confirmation as to whether or not personal data concerning him exist, regardless of their being already recorded, and communication of such data in intelligible form.
2. A data subject shall have the right to be informed:
a) of the source of the personal data;
b) of the purposes and methods of the processing;
c) of the logic applied to the processing, if the latter is carried out with the help of electronic means;
d) of the identification data concerning data controller;
e) of the entities or categories of entity to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as designated representative(s) in the State’s territory, data processor(s) or person(s) in charge of the processing.
3. A data subject shall have the right to obtain
a) updating, rectification or, where interested therein, integration of the data;
b) erasure, anonymization or blocking of data that have been processed unlawfully, including data whose retention is unnecessary for the purposes for which they have been collected or subsequently processed;
c) certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected.
4. A data subject shall have the right to object, in whole or in part,
a) on legitimate grounds, to the processing of personal data concerning him/her, even though they are relevant to the purpose of the collection;
b) to the processing of personal data concerning him/her, where it is carried out for the purpose of sending advertising materials or direct selling or else for the performance of market or commercial communication surveys.
